Terms and Conditions

Last Updated: August 13, 2026

Welcome to the Crescendo Community Arts website. These Terms and Conditions (“Terms”) govern your access to and use of the Crescendo Community Arts website, services, programs, events, and payment features.

By accessing or using this website, registering for a program or event, making a donation, purchasing a service or merchandise, or otherwise interacting with Crescendo Community Arts through this website, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the website or its payment services.

1. About Crescendo Community Arts

Crescendo Community Arts (“Crescendo,” “we,” “us,” or “our”) is a nonprofit organization dedicated to strengthening communities through music and the arts. We provide inclusive and accessible opportunities for children and families to learn, perform, connect, and grow through musical and artistic experiences.

These Terms apply to all users of our website, including donors, program participants, parents and guardians, volunteers, event attendees, and visitors.

2. Use of the Website

You may use this website for lawful purposes and in accordance with these Terms.

You agree not to:

  • Use the website for any unlawful or fraudulent purpose.
  • Attempt to gain unauthorized access to the website, its systems, or other users’ information.
  • Interfere with the operation or security of the website.
  • Submit false, misleading, or fraudulent information.
  • Use automated systems to access or collect information from the website without our permission.
  • Upload or transmit malicious software, viruses, or other harmful material.
  • Use content from the website in a manner that infringes our intellectual property rights or the rights of others.

We reserve the right to restrict or terminate access to the website when we reasonably believe that a user has violated these Terms or applicable law.

3. Donations

Crescendo Community Arts accepts voluntary donations through this website to support our mission and programs.

When you make a donation, you represent that:

  • You are authorized to use the payment method provided.
  • The information you provide is accurate and complete.
  • You authorize Crescendo or its designated payment processor to charge the amount you specify.

Unless otherwise stated at the time of donation, donations are intended to support Crescendo’s general charitable purposes. We may use unrestricted donations where they are most needed to support our mission, programs, operations, and community activities.

If you make a donation for a specific campaign, program, or purpose, Crescendo will make reasonable efforts to use the funds for that purpose. However, if circumstances change or the designated purpose is no longer feasible, we may redirect the funds to a substantially similar charitable purpose consistent with our mission and applicable law.

4. Payments and Payment Processing

Certain services, programs, events, merchandise, registrations, or other activities may require payment.

Payments made through this website may be processed by a third-party payment provider. Crescendo does not generally receive or store complete payment card numbers or other sensitive payment credentials submitted directly to the payment processor.

By submitting a payment, you authorize the applicable payment processor to process the transaction according to the payment information and amount you provide.

Third-party payment processors may have their own terms, conditions, and privacy policies. Your use of their payment services may therefore also be subject to those terms.

Crescendo is not responsible for technical problems, interruptions, declined transactions, or other issues caused by a third-party payment processor, financial institution, payment network, or other service outside our reasonable control.

5. Payment Authorization

Before completing a transaction, please review the amount and information you provide carefully.

By submitting a payment, you confirm that:

  • The payment information you provide is accurate.
  • You are authorized to use the selected payment method.
  • You authorize the transaction for the amount displayed at checkout.
  • You agree to any applicable program, event, registration, or purchase conditions displayed at the time of payment.

We reserve the right to refuse, cancel, or investigate a transaction if we reasonably believe it may be fraudulent, unauthorized, unlawful, or otherwise inconsistent with these Terms.

6. Refunds and Cancellations

Unless a different refund or cancellation policy is specifically stated for a particular program, event, registration, or purchase, payments are generally subject to the following guidelines.

Donations

Because donations are voluntary charitable contributions, donation refunds are generally not provided once a donation has been processed.

If you believe a donation was made in error, duplicated, or processed without your authorization, please contact us as soon as possible so that we can review the transaction.

Programs and Events

Refund and cancellation policies for programs, classes, registrations, concerts, and events may vary. When applicable, the specific refund or cancellation policy presented during registration or purchase will control.

If an event or program is canceled by Crescendo, we will communicate any available refund, credit, transfer, or alternative arrangements to registered participants as appropriate.

Unauthorized Transactions

If you believe your payment method was used without your authorization, please contact us promptly and, where appropriate, your financial institution or payment provider.

7. Recurring Donations

If Crescendo offers recurring or scheduled donations, the terms of the recurring donation will be presented before you authorize the transaction.

By enrolling in a recurring donation, you authorize the applicable payment processor to charge your selected payment method according to the schedule and amount you selected.

You may request cancellation of future recurring donations by following the available cancellation instructions or contacting Crescendo. Cancellation of a recurring donation does not automatically reverse donations that have already been processed.

8. Programs, Events, and Activities

Program and event information published on this website, including dates, times, locations, descriptions, instructors, performers, and availability, may change.

Crescendo reserves the right to modify, postpone, relocate, or cancel programs or events when reasonably necessary, including because of scheduling issues, facility availability, weather, safety concerns, staffing, or circumstances beyond our control.

Where appropriate, we will provide affected participants with notice of significant changes.

9. Children and Minors

Many Crescendo programs and activities are intended for children and young people.

A parent or legal guardian is responsible for registering a minor for programs or activities and for providing accurate information and required permissions.

Unless otherwise expressly stated, a child or minor should not independently submit registration information, make payments, or provide personal information through the website without appropriate parental or guardian involvement.

Parents and guardians are responsible for supervising minors participating in Crescendo activities in accordance with the requirements communicated for the applicable program or event.

Additional waivers, releases, consent forms, or participation agreements may be required for certain activities.

10. Photography, Video, and Recordings

Crescendo may photograph, record, or otherwise document concerts, rehearsals, performances, community events, and other activities for legitimate organizational purposes, including promoting our programs and mission.

Any use of identifiable images, recordings, or other media involving children or other participants will be subject to applicable consent requirements and any permissions provided for the relevant activity.

Where a separate media release or consent form is provided, that agreement will govern the applicable use of images, recordings, or other media.

11. Intellectual Property

Unless otherwise indicated, the content of this website, including text, graphics, logos, photographs, illustrations, videos, music-related materials, designs, and other original content, is owned by or licensed to Crescendo Community Arts and is protected by applicable intellectual property laws.

You may view and use website content for personal, non-commercial purposes related to learning about or participating in Crescendo activities.

You may not reproduce, modify, distribute, publicly display, sell, publish, or create derivative works from our copyrighted materials without prior written permission, except where permitted by applicable law.

The Crescendo Community Arts name, logo, branding, and related marks may not be used in a manner that suggests endorsement, sponsorship, or affiliation without our prior written permission.

12. User-Submitted Information and Content

Certain areas of the website may allow users to submit information, forms, comments, photographs, testimonials, applications, or other content.

You are responsible for ensuring that information you submit is accurate and that you have the necessary rights and permissions to submit any content belonging to another person.

You agree not to submit content that:

  • Is unlawful, fraudulent, threatening, abusive, defamatory, or discriminatory.
  • Infringes another person’s intellectual property or privacy rights.
  • Contains malicious software.
  • Contains sensitive personal information that is not necessary for the intended purpose.
  • Violates applicable laws or regulations.

We reserve the right to remove content that violates these Terms or that we reasonably believe is inappropriate or harmful to our organization or community.

13. Third-Party Websites and Services

Our website may contain links to third-party websites, payment providers, social media platforms, or other services.

These third-party services are not controlled by Crescendo, and their availability, content, privacy practices, and terms may differ from ours.

Crescendo is not responsible for the content, security, privacy practices, or availability of third-party websites or services.

Your use of third-party services is subject to the terms and policies established by those providers.

14. Privacy

Your use of this website may involve the collection and processing of personal information.

Our collection, use, and protection of personal information are described in our Privacy Policy.

By using the website, you acknowledge that you have had an opportunity to review our Privacy Policy.

15. Website Availability and Accuracy

We make reasonable efforts to maintain accurate and current information on the website. However, we do not guarantee that all information will always be complete, accurate, current, or free from errors.

We may update, modify, suspend, or discontinue any portion of the website at any time without prior notice.

We do not guarantee that the website will always be available, uninterrupted, secure, or free of errors or harmful components.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and its content are provided on an “as is” and “as available” basis.

Crescendo Community Arts makes no warranties, express or implied, regarding the website, its availability, its content, or its suitability for a particular purpose, except where such warranties cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Crescendo Community Arts and its directors, officers, employees, volunteers, representatives, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the website or inability to use the website.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

Participation in Crescendo programs and activities may also be subject to separate participation agreements, waivers, releases, or other terms.

18. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Crescendo Community Arts and its directors, officers, employees, volunteers, representatives, and agents from claims, liabilities, damages, losses, and expenses arising from your violation of these Terms, your unlawful use of the website, or your infringement of another person’s rights.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes to our website, programs, payment services, legal requirements, or organizational practices.

When we make changes, we will update the “Last Updated” date at the beginning of this document.

Your continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.

20. Governing Law

These Terms will be governed by and interpreted in accordance with the laws applicable to Crescendo Community Arts, without regard to conflict-of-law principles, except to the extent otherwise required by applicable law.

Any disputes arising from or relating to these Terms or your use of the website will be handled in a court or other forum with appropriate jurisdiction, subject to any rights or requirements provided by applicable law.

21. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms, together with any applicable policies, waivers, registration agreements, event-specific terms, and our Privacy Policy, constitute the terms governing your use of the website and applicable Crescendo services.

If a specific program, event, purchase, or registration contains terms that conflict with these Terms, the specific terms applicable to that transaction or activity will control to the extent of the conflict.
